Court documents obtained by The Ashley reveal that both parties have completed their case disclosures and are scheduled to attend a mediation conference on May 21, 2025.

While the progression of custody cases often follows predictable steps, Christine and Kody’s case took an unexpected turn this week when the court classified it as both Track 1 and Track 3. Under Utah’s domestic court system, Track 1 is standard, but Track 3 is reserved for cases involving significant custody disputes. According to the Utah State Courts website, Track 3 assignments typically involve high-conflict cases, including those with allegations of child abuse or domestic violence.
“For a Track 3 case, at the case management conference the court and parties will address whether a custody evaluation is necessary and whether a private guardian ad litem should be appointed,” states the court’s website.
While The Ashley notes that there is no confirmation of allegations of abuse or violence in this case, Track 3 designation underscores the complexity and conflict involved in the custody battle.
Christine Demands Paternity Test for Truly
Christine’s legal filing — a “Petition for Declaration of Paternity, Child Custody, Parent Time, and Support” — requests that Kody take a paternity test to confirm his biological relationship to Truly. As fans of Sister Wives may recall, Christine was Kody’s third wife in their polygamous family. Their marriage was not legally recognized, and Kody’s name does not appear on the birth certificates of the six children he shares with Christine.
According to court records, a fee was paid for a paternity-related process on October 23, the same day Kody filed his response to Christine’s lawsuit. This indicates that the paternity test has either been completed or is currently underway.
Court Shields Personal Details from Public View
Both Christine and Kody appear to be taking measures to protect their family’s private information. Sensitive details, such as income declarations and other personal data, have been marked as “not public” in court filings. These documents are accessible only to the court, legal counsel, and the parties involved.
Moreover, Wednesday’s court hearing was not recorded, photographed, or transmitted, per the court’s ruling. Any attempt to do so would have resulted in charges of contempt of court, punishable by fines or jail time.
